OAB SP expands discussion on piracy and intellectual property rights

Contemporary challenges for content protection, innovation, and artificial intelligence were discussed by experts and academics.

The São Paulo Bar Association (OAB SP), through its Academic Law Commission, held a debate last Tuesday (15) on “Piracy and Intellectual Property: Limits, Legislation, and Collective Consciousness” in the OAB SP's Noble Hall in downtown São Paulo. The event featured reflections and notes on piracy, copyright infringement, AI, and how to protect such content in the face of innovations and technological changes in society, which have impacted the legal field.
The panel was composed of the president of the OAB SP Academic Law Commission, Aleksander Mendes Zakimi, students Larissa Braga, Marcela Leitte, and Pedro Soares Galvão, and featured the special participation of lawyer Daniel Avila Failla, a specialist in business law, intellectual property, and digital law.
Failla broadly addressed the fundamentals of intellectual property and its main pillars, such as copyright, trademarks, patents, industrial design, and software, in addition to the role of the National Institute of Industrial Property (INPI), the agency responsible for granting and registering these rights. He also pointed out the contemporary challenges related to piracy and artificial intelligence, which have caused profound changes in the ways content is consumed, created, and protected. In closing, the expert argued that more inclusive business models can broaden access and strengthen public engagement. According to him, it is essential to seek a balance between legal protection, social inclusion, and adaptation to new technologies.
"As we have seen, the intellectual property system was created to encourage innovation, and this is important for us as a society, it is important for companies and for the individuals who work with it. Companies are increasingly digitized, and intellectual property is essential for this ecosystem to be preserved and, in a way, for innovation to always be encouraged. Thinking about AI, it will be even more challenging because it brings speed and dynamism to the development of new products and new ethical and legal issues that will need to be discussed and resolved quickly," he concluded.
The committee chair, Aleksander Mendes, assessed that the topic is increasingly present in everyday life, that it should be expanded within educational institutions, and that the purpose of the meeting was precisely to introduce the topic to students, paving the way for new professional opportunities in law.
