BPTO | New Regulation - Secondary Meaning

On June 10th, The Brazilian Patent and Trademark Office (BPTO) published INPI/PR Ordinance No. 15, bringing an important innovation to the Brazilian industrial property scene. For the first time, the agency formally regulates the criteria and procedures for proving Secondary Meaning - in the context of trademark registrability examination.



The new regulations only come into force on November 28th, 2025, and aim to modernize and make the trademark system in Brazil more flexible, bringing it into line with the practices adopted in various foreign jurisdictions.
