Recently, the São Paulo State Court issued an important ruling recognizing the standing of the São Paulo State Board of Trade (JUCESP) as a defendant in a lawsuit seeking the cancellation of business registrations created fraudulently through the misuse of a trademark duly registered with the BPTO.
In addition to declaring the registrations null and void, the ruling imposed a systemic restriction to prevent new registrations containing the terms used in the fraud, thereby strengthening the protection afforded to trademark owners.
